Join us for a hands on intermediate to advanced SLAPPinar on the elusive "gravamen" concept that has permeated California anti-SLAPP jurisprudence since the 2002 High Court decision in City of Cotati v. Cashman (2002) 29 Cal.4th 69.

Subsequent cases have mangled and misapplied the “gravamen” concept by applying it to the first prong analysis of mixed causes of action, adding to the confusion surrounding an already difficult cause of action.

The significant disagreement among the various Appellate Districts,  as to the proper formulation and application of the "gravamen" rule, will be pointed out and discussed.

To make matters more complex, there is an often missed reverse "gravamen" rule that applies on the second prong analysis designed to help plaintiffs survive SLAPP motions on the probability of prevailing - merits prong. 

The speaker will analyze actual complaints when explaining the "gravamen" issue. 

Finally, there will be a brief discussion of the recent exception to the no amendment rule and how expert declarations in SLAPP fee motions can dramatically affect the result.
