Course Summary

SLAPP law suits, or “Strategic Law Suits Against Public Participation,” have proliferated in California over the past two decades. In fact, these suits are so popular, there is even a new litigation response, the “SLAPPBACK.” It is important to know what is involved in this type of suit and how to either file one as a plaintiff, or respond to one on behalf of your client.

This seminar is taught by a Superior Court Judge, a long-term career court attorney for the California Appellate Court and an experienced practitioner.  The program gives you an in-depth look at both sides of the coin when dealing with a SLAPP suit.

This seminar takes you step-by-step through the defendant’s and plaintiff’s positions, the motion process, what to expect, what is involved at the procedural level, the appeals process and what each party’s options are.

Judge Mayeda served as a judge for 26 years until retiring in 2007. Beginning in 1997, he heard superior court civil cases on assignment and continued to do so as a Los Angeles County Superior Court judge since 1999. From 1981 to 1999, he was a judge on the Los Angeles Municipal Court, serving as Presiding Judge in 1990 and Assistant Presiding Judge in 1989. He was a deputy city attorney in the Office of the Los Angeles City Attorney from 1973 to 1981. In addition, he was a customs inspector for the U.S. Customs Service from 1968 to 1972.

Judge Mayeda is a founding member of the Asian Pacific American Bar Association of Los Angeles County and continues to be a member today. He is also a member of the California Judges Association, California Asian Judges Association, and the Japanese American Bar Association of the Greater Los Angeles Area.

In addition, he served as chair of the Judicial Administration Institute of California and a member of the Judicial Council of California. He has taught and developed curriculum for judicial branch education through the Continuing Judicial Studies Program, the Judicial Administration Institute of California, and the California Judicial Education and Research Governing Board.

He earned his J.D. from the University of California at Los Angeles School of Law in 1971, and his A.B. from the University of Redlands in 1968.

Philip L. Goar, Esq.

Since 1983, Mr. Goar has been a senior judicial attorney at the California Court of Appeal.  He is certified as an appellate specialist by the State Bar of California Board of Legal Specialization and has been a speaker and panelist at numerous programs sponsored by the State Bar, L.A. County Bar, CEB and CJER. Mr. Goar received his Juris Doctor degree from the University of Southern California in 1967.   Mr. Goar spent thirteen years in Legal Services programs for the poor including the Legal Aid Foundation of Long Beach, the National Senior Citizens Law Center and the Western Center for Law and Poverty where he was Director of Litigation from 1972 to 1976.

James Joseph Moneer, Esq.

James J. Moneer, Esq. has been representing plaintiffs and defendants in all aspects of anti-SLAPP cases throughout California since 1994 - a year after section 425.16 became effective. 

Mr. Moneer frequently testifies as an expert for parties making or opposing SLAPP fee motions.  He also handles civil appeals and writs. 

Mr. Moneer has been recognized as an expert on California Anti-SLAPP law in Ramona Unified School Dist. v. Tsiknas (2005) 135 Cal.App.4th 510, 523-525 and Dowling v. Zimmerman (2001) 85 Cal.App.4th 1400.  He was lead counsel in five published anti-SLAPP decisions, including one before the California Supreme Court. Soukup v. Hafif (2006) 39 Cal.4th 260.  He was amicus counsel before the High Court in numerous other cases. 

He is a frequent lecturer on the topic, teaches anti-SLAPP law at USD School of Law, and has published numerous articles on the subject.

Benjamin G. Shatz

Mr. Shatz is certified as an appellate law specialist by the California State Bar Board of Legal Specialization and is a member of  the Appellate Practice Group in the Los Angeles office of Manatt, Phelps & Phillips, LLP.  He has briefed hundreds of civil appeals, writs and petitions to the U.S. Supreme Court, U.S. Courts of Appeals, California Supreme Court and California Courts of Appeal, covering a variety of practice areas.  Mr. Shatz frequently contributes appellate law articles to periodicals including CEB’s Civil Litigation Reporter, Los Angeles Lawyer, California Lawyer, and the Daily Journal.  He is the Chair of the Los Angeles County Bar Association’s Appellate Courts Committee and the Vice Chair of the California State Bar's Committee on Appellate Courts.  He has been named by Los Angeles Magazine and Law & Politics Magazine as one of Southern California’s “Super Lawyers” in the field of Appellate Law, 2004-2010.

Mr. Shatz also served as Law Clerk to the Honorable Robert J. Johnston, United States Magistrate Judge for the District of Nevada and as Extern to the Honorable Dorothy W. Nelson, United States Court of Appeals for the Ninth Circuit.  Mr. Shatz graduated magna cum laude from Pepperdine University School of Law, and was an Associate Editor of the Pepperdine Law Review and an Assistant Editor of the California Supreme Court Survey.
